Of course the vote had to fail. Senate is Dem controlled and they are anti-legal presently. But the fact that it got voted down by a few votes should give us some optimism.

keep supporting EB3 porting .. you wil then get your GC in 7 years
If somebody is eligible to jump from Eb3 -> EB2, then he should be allowed to jump.
I am EB2. I had to change my job as my previous employer didnot allow me to file in EB2 as I didnot have prior experience even though i have MS from USA.
I changed my job and now I am in EB2. My PD is Feb 2008. Sucks that I missed the bus in July 2007.
Nobody should go through what I went through. If somebody is eligible to jump, then he should jump from EB3->EB2.
Considering the current delays in labour and I140 approvals, I think the entire process of filing for new labor, then I140 and the PD porting will take around 2yrs if there are no Queries. :p
Unless somebody's PD is mid 2006 or 2007 above in EB3, I dont think this EB3->EB2 jump will be helpful. :rolleyes:

Please make appropriate changes to the letter stating the we are also the victims of DOL's backlog elimination center and at every stage of this process its taking years to get through. Mail your letter and completed Form 7001 to Ombudsman's office and lets see what they do it about it. Please post any responses you receive from Ombudsman's office.

I did not see MS in any discipline.

They also had something like a CS diploma (don't remember details). They had 10 (??) theoretically sound courses. Students in most US schools will not be able to handle these courses.

Pardon my ignorance.... Can you enlighten me as how Vertical and Horizontal spillover works ? What exactly happens in Vertical spillover and how is it different from horizontal.
horizonal is unused visa's from a category flow down to other categories this way:
EB2 ROW -> EB2India + EB2China -> EB3 ROW -> EB3 I+C, or
EB2 ROW -> EB2India + EB2China -> EB3 (ROW+I+C)
there is some controversity about the last one, some people believe it flows through EB3 ROW and comes down, others say EB3 is all treated equal. Based on data in the past (the fact that EB3 India got tens of thousnads of approvals in 05 and 06 even though EB3-ROW was retrogressed, means its mostly the latter (EB3 (ROW+I+C))

you need to stop getting answers from others and solve this problem amicably with you wife. There is nothing better than a one-one discussion with her.
Marrying is like buying a company, you have a moral obligation to account for any liabilities she may have.
Understand, she may have been the sole income earner in India for her parents. It doesnot hurt for you to send say 200-300 dollars every month. 700 dollars every month from your check is not that big deal (350 for each family). Don't make it a long term solution.
You have filed 485, what stops your wife from getting a job here?? Does she want to stay at home, watch TV and enjoy life? if she thinks that way, let her know, if she wants to send money to her parents long term, she needs to get out of house, find a job
Your wife should also have the heart to not burden you with financial requests. If she can get a job here, she should. If she earns money, its her's and its upto her how she spends that. If you can afford to tell her that, do it.

I'm sure IV does not agree with you and that's not the IV goal. Focus is on to make USCIS accept what they promise and that is accepting the applications files on July for AOS.

As far as attorney's fees are concerned, lot of attorney's are going to refile without any charge or for some additional meagre fees.

Neither the USCIS nor anyone else have real hard numbers of how many are in each in queue. So, what makes you think that you will NOT be stranded again, like us, in the latter queue. Let me tell you; things are not pretty. PERM has eased or will ease LCs and backlogs. The attempt at IV will help folks affected by retrogression take less years to apply for I-485.
I dont expect the wait to be any less longer .. But I would surely welcome priority date being based on H1 start date as it would be more fair method

All they had to do was to introduce another $2000 fee for every Green Card Re-Captured. Most of us would have been out of this mess and they would have got the money they needed. This Grand posturing is extremely disturbing and i hate the politics behind it.
I wish the Democrats lose big time and lose their hold from Senate and house.
we all seem to think that after our problem is fixed, all the problems in the world will be gone..... if there is hunger problem, our solution ought to be increase in eb quota..... if there is drinking water problem, our solution is recapture.....
my reading is that chinese & indians think too much of themselves.... as if the world would collapse without them..... very narrow thinking..... now u would see a few here blaming indian politicians, some saying outsourcing will increase, some saying US will lose more jobs, world will fall apart...... well that's just too much reality for one day
lets get back to the important subjects of eb3 & eb2, crapy data analysis, shitty predictions & lets find out who is better than everyone else, is eb2 better more deserving that eb3....... or will the world stop spinning if the dates do not progress in the next month visa bulletin....... & those self-importance professing indian press articles..... these r the discussions we should be having.... can we please get back to those more important topics.....
