How are things going? Any luck with job hunting? Yes you are right every state is different regarding requirements. Your best bet is to look hard in NY. Call up PT colleagues, the ones you know well and the ones you don't! Let them know there is a PT that needs a job! AND DON'T tell the employer you need them to sponsor you until at the interview. Let them see you, like you and like what you have to offer! Very important! Then they will do whatever it takes to get you on board.

I left old job 10 months before July 07. But attorney at new employer did mistake with advertisement, and PERM got rejected. Applied again, and USCIS audited all Fragomen cases, so mine stuck there attorney being Fragomen. By then July 07 was gone. In Sept 08 again my PD (Nov 05) was current but I was stuck with Audit.... Finally I got PERM approved, 140 approved, but since then NOV 05 is far far away....

Are you sure it was Atlanta and not Chicago?. Your timeline suggests it was applied in Chicago.
My company applied for PERM ALC EB-2 category at Atlanta on 18th June 2007, got it approved on 20th June. Received hard copy on 26th June.

hey,
It seems like you are inspiring lot of peoples to upgrade to EB2 which is good. Actually saying this and really doing a successful upgrade takes time and depends on lot of things like economic situation.
After my Eb3 I-140 finally got Approved in Jan 2009 , I started searching for employers who would do the Eb3 to Eb2 upgrade .. But there was no job , not even contracts - so who will file a EB2 PERM labor for you in that situation ? Plus if someone files a EB2 Labor just like that - they could be audited. The Job needs to be EB2 level and you need to have Eb2 qualifications which lot of Eb3 has - But both conditions has to meet for a "successful upgrade".
What do you say ? Do you know any other shortcut than what i mentioned - then please enlighten us :)

Absolutely wrong. If husband and wife are filing a joint tax return, it is wrong on her part to send money to her parents without informing her husband. I do agree with your point that information about transactions should be known to both parties. To answer your question, yes, in my opinion, it is perfectly OK for a man to send money to his parents since the man is earning. If the girl earns, she earns that right.
Say, when the couple goes to India for a vacation, I totally support the girl buying gifts similar to what the man has bought for his family/relatives. I also support assistance based on humanitarian needs for girl's parents. ONLY when it is comes to demands of sending monthly allowance or occasional lump sum, a line needs to be drawn.

I am working with a bank for my new Mortgage. The bank is asking for 3 year continuous VISA (forward) as a requirement.
My situation is H1 + 485 (I-140 Approved)
my current H1 will expire in December 2009, I cannot apply for extension until June 09 (180 days )
but Bank guys are asking for 3 yr VISA, they are not even looking on my H1b Approval letter as there is a line mentioned in there as "This form is not a visa nor may it be used in place of a VISA"
Anybody have similar experience ? and any suggestions of how to approach / explain this to bank guys ?

Porting is a legally supported practice which is tied to LABOR and JOB requirements, not to one's esteemed sense of self worth.
There are numerous BUSINESS reasons why EB3 to EB2 porting is allowed. Why not focus on other forms of irrational immigration practice like the 7% quotas which amount to discrimination based on national origin?

That means your son is also able to file 485, right? In that case he will not age out once an AOS is submitted for him. I am assuming your 140 will be approved before he turns 21.

Yes I believe paperwork will be filed for all my dependants concurrently. Does it even matter when the I140 is approved?
It seems that under the new law his cutoff date is Jun 1 since that is when my priority date will be current so as long as he applies for a green card within one year he is ok.
So if we apply concurrently when is his green card application deemed to have been applied for? When we file concurrently or only when and if the 140is approved.
What do you think?

The 'effective date' ( Oct 1, 2008 ) does not apply for applications filed after May 15, 2007. I will be glad if you can prove me wrong :)

Later assume that I-485 date becomes current for that particular person (before Oct 2008), he/she files for the AOS/I-485 (before Oct 2008). When I started my process in 2005 I was told that the whole thing will take 2-3 years. It is almost 4 years now and based on the VB movement for the last few months I have been thinking that this process can easily take 6-7 years and now DOS says it may as well take decades for those born in India. :mad:
